SMS Messaging Terms (Consent + Opt-Out + Compliance)

By providing your phone number through our website, booking system, forms, intake process, or otherwise opting in, you expressly consent to receive SMS/text messages from Ascension IQ, Inc. at the number you provided.

Messages may include:

  • scheduling and appointment reminders
  • onboarding and service updates
  • support communications
  • follow-ups related to your inquiry
  • marketing or promotional messages (where permitted)

Message frequency varies. Message and data rates may apply.

You may opt out at any time by replying STOP.

Consent is not a condition of purchase.

We do not guarantee delivery or timing of SMS messages. Delivery is dependent on mobile carriers, device settings, network availability, and third-party service providers.

You represent that you are the authorized user of the phone number submitted and that you have the right to provide consent for communications to that number.

Email Marketing + Unsubscribe

By providing your email address to Ascension IQ, Inc., you consent to receive email communications that may include:

  • responses to inquiries
  • proposals, onboarding messages, and service updates
  • educational and marketing content

You may unsubscribe from marketing messages at any time by using the “Unsubscribe” link in our emails.

Even if you unsubscribe from marketing emails, we may still send operational or transactional emails necessary to provide Services, including:

  • appointment confirmations
  • invoices and receipts
  • service notices and policy updates
Compliance Acknowledgment (Client Marketing Systems)

If we help you build or deploy outbound or inbound communication systems (including email and SMS automations), you acknowledge and agree that you are responsible for ensuring compliance with all applicable laws, rules, and platform policies, including, where applicable:

  • TCPA (Telephone Consumer Protection Act)
  • CAN-SPAM Act
  • state privacy and consumer protection rules
  • carrier, platform, and provider messaging policies

We may provide best-practice guidance; however, you remain solely responsible for your messaging content, consent practices, audience lists, disclosures, and compliance obligations.

No Guarantees / Results Disclaimer

You understand and agree that we do not and cannot guarantee specific results, including but not limited to:

  • lead volume
  • booked calls
  • revenue increases
  • conversion rate improvements
  • deliverability or inbox placement
  • response rates from outbound outreach

Results depend on many factors outside our control, including your offer, pricing, audience, reputation, domain health, deliverability conditions, market dynamics, and third-party platform changes.

Third-Party Platforms + No Responsibility for Suspensions

Our Services may require or involve third-party tools (CRMs, website hosting, email/SMS providers, analytics, automation platforms, etc.). You acknowledge that third-party providers control their own platforms and may change features, pricing, access, or policies at any time.

We are not responsible for:

  • outages, downtime, or service disruptions
  • account restrictions, suspensions, bans, or deliverability filtering
  • API changes that affect integrations
  • limitations imposed by carriers or platforms
Limitation of Liability 

To the maximum extent permitted by law, Ascension IQ, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or reputational harm.

To the extent liability is found, our total liability for any claim relating to the Site or Services will not exceed the total fees you paid to us in the thirty (30) days immediately preceding the event giving rise to the claim.

Governing Law / Venue (New York)

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in New York, New York, and you consent to personal jurisdiction and venue in those courts.
